Frequently asked questions about betting in United States

Is online sports betting legal in the United States in 2026?
Legal in about 38 states, illegal in the others. The 2018 Supreme Court decision in Murphy v. NCAA struck down PASPA, letting each state decide independently — New Jersey, Pennsylvania, New York, Michigan, Illinois, Virginia, Colorado, Arizona, Massachusetts, Ohio, Kentucky, Maryland, Louisiana, Tennessee, North Carolina and around 25 others have full online sportsbooks. California, Texas, Florida (Hard Rock retail only), Utah, Idaho and Hawaii do not. Availability is enforced by geolocation — you must be physically inside a legal state at the moment you place the wager, regardless of where you live. Every operator on this shortlist is licensed by at least one state gaming commission.
How is federal tax on winnings handled?
The IRS treats gambling winnings as ordinary income. Sportsbooks issue a W-2G form and withhold 24% federal tax on winnings above $5,000 from a single wager (or 300× the stake for some game types). All winnings are taxable and should be reported on your annual 1040 whether or not a W-2G was issued. You can deduct gambling losses up to the amount of winnings, but only if you itemize — most casual bettors take the standard deduction and can't. Some states add their own income tax on winnings on top of the federal rate.
How does state-by-state availability actually work?
Every legal operator uses geolocation software (usually GeoComply) that checks your device's GPS or Wi-Fi triangulation at the moment you try to place a bet. If you're inside a state where the operator is licensed, the wager goes through; if you're outside, it's rejected. Registration itself doesn't require you to live in that state — you can open a DraftKings account from Texas and log in fine, but you can only bet when you're physically in NJ, PA, NY, or another state where DraftKings holds a licence. Deposits and withdrawals are unaffected by location. Around 15% of the market uses multi-state accounts this way for weekend trips.
What payment methods work at US sportsbooks?
PayPal is dominant — instant deposit and same-day withdrawal at DraftKings, FanDuel, BetMGM, Caesars and most other legal operators. PayPal Play+ is the operator-branded prepaid card that most sportsbooks issue, with instant funding and ATM withdrawal. Venmo, Apple Pay and Google Pay work at the tier-one operators. ACH bank transfer (VIP Preferred) is the default for larger amounts — 1–3 banking days. Visa and Mastercard from US issuers work but with a caveat: Bank of America, Chase and Citi block gambling merchant category codes as of 2024, requiring the workaround of PayPal or Play+. Crypto is not a legally recognised payment method at US-licensed operators.
What are prediction markets like Kalshi and are they legal?
Kalshi is a CFTC-regulated event-contract exchange — you buy YES/NO contracts on outcomes (elections, weather, sports, Fed rate decisions) at prices set by real trading, not fixed odds set by an operator. Legal in every US state including Texas, California and Florida because it's regulated federally by the CFTC as a commodities exchange, not by state gaming commissions. Contract profits are taxed as Section 1256 gains (60% long-term / 40% short-term rate), which is often more favourable than the 24% ordinary-income treatment on sportsbook winnings for high earners. Polymarket, the larger prediction market, is close-only for US residents — you can settle existing positions but cannot open new ones from a US location.
Where can I get help with problem gambling in the US?
The National Problem Gambling Helpline is 1-800-GAMBLER — free, confidential, 24/7, operated by the National Council on Problem Gambling. Every legal state operates its own voluntary self-exclusion registry through the state gaming commission; New Jersey (IWonders), Pennsylvania (SEL program), and Michigan (MGCB registry) block registered users at every licensed operator in that state simultaneously. Registration lengths run from one year to lifetime depending on the state. Gamblers Anonymous (gamblersanonymous.org) runs in-person meetings in every major city and phone/online meetings nationally. Individual operators offer per-account deposit limits, session limits and cooling-off periods layered on top.

Betting in the United States: what actually matters in 2026

The US online sports betting market is unique in one specific way: there is no federal regulator. Every state sets its own rules, licenses its own operators, and enforces its own tax regime. Since the 2018 Supreme Court decision in Murphy v. NCAA struck down the Professional and Amateur Sports Protection Act (PASPA), roughly 38 states have legalised online sports betting — the largest markets being New Jersey, Pennsylvania, New York, Michigan, Illinois, Virginia, Colorado, Arizona and Massachusetts. California, Texas, Florida (Hard Rock retail-only), Utah, Idaho and Hawaii still don't. What that means for you: the shortlist below covers operators licensed in the largest legal states, and where you can bet depends on where you physically are the moment you tap "Place Bet".

How state-by-state licensing actually works in practice

Every legal US sportsbook uses geolocation software — GeoComply is the industry standard — to verify your location at the moment of every wager. Your device's GPS or Wi-Fi triangulation gets checked against the state's coverage polygon. Inside a legal state: bet placed. Outside: request denied. Registration doesn't require you to live in a legal state — you can open a DraftKings account from a hotel in Dallas — but you can only place wagers from a legal state. This is why frequent travellers open accounts at multiple operators licensed across different states.

The federal tax reality — 24% withholding + state overlay

The IRS treats gambling winnings as ordinary income under Section 61. Sportsbooks send you a Form W-2G and withhold 24% federal tax on winnings above $5,000 from a single wager (or 300× the stake for parimutuel-style games). Even smaller winnings are legally taxable — the $5,000 threshold triggers automatic withholding but doesn't set the reporting floor. Everything goes on your annual Form 1040.

Losses can offset winnings up to (but not exceeding) the winnings amount, and only if you itemize deductions on Schedule A. Since around 90% of US filers now take the standard deduction, this offset is unavailable in practice for most casual bettors. On top of the federal withholding, most legal states add their own state income tax — 3–10% depending on state — which the sportsbook reports but usually doesn't withhold. Keep records of every wager for tax time; the major operators provide downloadable annual statements.

Payment methods that actually work at US sportsbooks in 2026

The US payment stack has consolidated around a specific set of rails since 2020:

  • PayPal — the single most important method. Instant deposit, same-day withdrawal at DraftKings, FanDuel, BetMGM, Caesars and every other tier-one operator. PayPal essentially decides which sportsbooks are viable in this market.
  • PayPal Play+ / operator-issued Play+ cards — a prepaid Visa/Mastercard that the sportsbook loads with your winnings. Comes with a physical card for ATM withdrawal and can be used at any merchant. Instant funding, free issuance.
  • Venmo, Apple Pay, Google Pay — supported at DraftKings, FanDuel and BetMGM. Instant deposits, same-day withdrawals for verified accounts.
  • ACH bank transfer (VIP Preferred) — the default for withdrawals over $500. Direct debit from your bank account, settles in 1–3 banking days.
  • Visa / Mastercard from US issuers — supported, but with a big caveat: Bank of America, Chase, Citi and Wells Fargo have blocked gambling merchant category codes since 2024, so most cards don't work directly. Capital One and regional banks still process. PayPal or Play+ is the workaround.
  • PayNearMe — cash deposit at 7-Eleven, Family Dollar and CVS. Useful for players who don't want to link a bank account.

Crypto is not a legally recognised payment method at any US state-licensed sportsbook. Any site accepting Bitcoin for US sports betting is operating outside the state licensing framework.

What to bet on in the US in 2026

Every year of the 2026 calendar hits a peak US betting event. Where the sportsbooks in this list are being judged:

  • NFL Super Bowl LX (February 2026, Levi's Stadium, Santa Clara) — the biggest single betting day of the year. Every legal operator runs enhanced-odds specials, prop bet menus expanding to 500+ markets per game, and same-game parlay boosts.
  • FIFA World Cup 2026 (June–July 2026, USA / Mexico / Canada) — the US is a host nation for the first time since 1994. Expect unprecedented US-market advertising and enhanced-odds for the USMNT run. Every legal operator has expanded its soccer product for 2026.
  • March Madness — the NCAA basketball tournament drives the second-largest betting handle of the year. Bracket contests, live-betting quality and futures markets are all differentiators here.
  • NBA, NHL, MLB regular seasons + playoffs — the everyday product. Where sportsbooks compete on live-odds latency, cash-out, same-game parlay pricing and player-prop depth.
  • UFC, PGA, F1 — non-team-sport breadth. The best US operators price these at competitive vig; the smaller books charge 15%+ margin.

Prediction markets — the Kalshi / Polymarket angle

The US has one legal alternative to traditional sportsbooks: federally-regulated prediction markets. Kalshi is a CFTC-supervised event-contract exchange where you buy YES/NO contracts on outcomes — everything from Fed rate decisions to Super Bowl winners to weather events. Legal in every US state including Texas, California and Florida because it's regulated federally as a commodities exchange, not by state gaming commissions. Prices are set by real trading, not fixed operator odds, so the "vig" comes from bid-ask spreads instead of a house edge.

Tax treatment differs: contract profits are Section 1256 gains (60% long-term / 40% short-term rate), which is often more favourable than the 24% ordinary-income rate on sportsbook winnings for high earners. Polymarket, the larger prediction market by volume, is close-only for US residents — you can settle existing positions but cannot open new ones from a US location. Kalshi is the practical US-legal option.

Responsible gambling — the US resource stack

The National Problem Gambling Helpline is 1-800-GAMBLER — free, confidential, 24/7, operated by the National Council on Problem Gambling. Every legal state runs its own voluntary self-exclusion registry through the state gaming commission: New Jersey's IWonders, Pennsylvania's SEL, Michigan's MGCB registry, New York's NYSGC register. Enrolling blocks you at every licensed operator in that state simultaneously; durations run from one year to lifetime depending on the state. States do not share self-exclusion registers with each other — a New Jersey exclusion doesn't cover Pennsylvania.

Individual sportsbooks layer their own tools on top: per-account deposit limits, session length limits, and cooling-off periods you can activate at any time. Gamblers Anonymous (gamblersanonymous.org) runs in-person meetings in every major US city plus phone and online meetings nationally. If you are worried about someone else's gambling, Gam-Anon offers dedicated support.

How we ranked this shortlist

Each operator is scored across four weighted criteria — payments and cash-out speed (30%), licensing and consumer protection (25%), bonus value net of terms (25%), and support and product quality (20%). Scoring is refreshed monthly against a real US-verified account running a full deposit-play-withdraw cycle in New Jersey. We only feature operators with at least one active state licence; offshore operators accepting US players fall outside this list. Full methodology is at the top of the page.
